REFER A FRIEND – iPad2 Sweepstakes
OFFICIAL RULES
NO PURCHASE OR REFERRAL NECESSARY TO ENTER OR WIN. A PURCHASE OR REFERRAL DOES NOT INCREASE ODDS OF WINNING.
1. Date(s) of Sweepstakes: The Amigo Energy Sweepstakes (“Sweepstakes”) will begin at 12:01 a.m. Central Time (“CT”) on December 1st, 2011 and end on or about 12:00 a.m. CT on January 31st, 2012 (“Sweepstakes Period”).
2. TO ENTER: During the Sweepstakes Period, there are two (2) ways to enter. 1) During the official contest period, existing Amigo Energy customers (“Referring Customer(s)”) will automatically get his/her name entered into a raffle drawing for a chance to win an Apple iPad 2 upon the enrollment of a new residential customer. There is no limit to the number of referrals a customer may make during the Contest period. Entries generated by a script, macro or other automated means will be disqualified. Referrals that are incomplete or improperly solicited are void and will not be accepted. Or, 2) By Mail Without Referring: Mail a card or piece of paper hand-printed with your name, complete address, telephone number (including area code) and date of birth in an envelope with proper-postage affixed to: Refer-a-Friend iPad drawings, Amigo Energy, 3800 Buffalo Speedway, Ste 500, Houston, TX 77098. Mail-in entries must be postmarked by January 31st, 2012, and received by Febuary 1st, 2012. Enter as often as you wish; however, there is a limit of one (1) mail-in entry per stamped outer envelope. Entries generated by a script, macro or other automated means or by any means which subvert the entry process will be disqualified. All entries become the property of Sponsor and will be not be acknowledged or returned.
3. DRAWING: Potential winner will be selected in a random drawing held every month from all eligible entries received. Odds of winning depend on the number of eligible entries received. Potential winner will be notified by phone, mail and/or email and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within thirty (30) days of date of issuance. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, potential winner is not in compliance with these rules, or Sponsor is unable to contact a potential winner within a reasonable time period, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.
4. PRIZE: Apple iPad2®16GB WiFi tablet device. Estimated retail value: $499.99. WIRELESS PLAN IS NOT INCLUDED AS PART OF PRIZE. Prize may not be substituted and is not transferable, except at Sponsor’s sole discretion. Prize is not redeemable for cash or exchangeable for any other prize. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion. All federal, state and local taxes as well as any other expenses associated with prize acceptance and use not specified herein as being awarded are winner’s sole responsibility. Prize is awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion.
5. DECISIONS: By participating in the Sweepstakes, participants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all matters. Sponsor reserves the right, in its sole discretion, to disqualify any participant or winner and may refuse to award the prize to a person who is ineligible, who Sponsor believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or has acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person, or obtained winner status using fraudulent means. Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning these rules or the Sweepstakes and Sponsor’s decisions concerning such disputes shall be final and binding. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor may waive any of these rules in its sole discretion.
6. ELIGIBILITY: This Sweepstakes is intended for participation in the State of Texas only. Please do not enter if you are not located in the State of Texas. The Sweepstakes is open legal U.S. residents who reside in Texas, 18 years of age or older, who are active customers of Sponsor as of the day prior to the start of the Sweepstakes. Void outside of Texas and wherever prohibited or restricted by applicable federal or state laws and regulations. Employees of Amigo Energy (“Sponsor”), its parent, subsidiaries, affiliates, officers, directors, agents, employees, advertising and promotion agencies (collectively, “Released Parties”) and members of their immediate families (spouses, parents, children, and siblings and their spouses, regardless of where they reside) and households, whether or not related, are not eligible.
7. USE OF PERSONAL INFORMATION: Sponsor may collect personal data about participants when they enter the Sweepstakes. Personal information collected in connection with this Sweepstakes will be subject to Sponsor’s privacy policy, available at http:// http://www.amigoenergy.com/privacy.aspx.
8. PUBLICICTY GRANT: By participating, all participants and winner(s) grant Sponsor and its designees permission to use their names, cities and states of residence, photographs, voices, and likenesses in connection with promotion of this and other Sweepstakes in any and all media now or hereafter devised, in any manner, throughout the universe, in perpetuity, without permission or compensation from, or notification to, participant.
9. RELEASE: By participating in the Sweepstakes, each participant and winner waives any and all claims of liability against Released Parties for any personal injury or loss resulting, in whole or in part, directly or indirectly, from the conduct of, or participation in, the Sweepstakes, or from the use of the prize.
10. GENERAL: Any attempt by an entrant or any other individual to deliberately damage the Sweepstakes or any website or undermine the legitimate operation of the Sweepstakes is in violation of criminal and civil laws. Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such entrant or individual to the fullest extent permitted by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard for conflicts of law doctrine, and all proceedings shall take place in Harris County, Texas.
11. DISCLAIMER: Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, illegible, garbled or postage-due entries, referrals, mail or email; or for mechanical, technical, electronic, communications, human, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, inaccurate, garbled or delayed transmission of entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes or other errors or difficulties of any kind related to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Sponsor shall not be liable to winner or any person claiming through winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control.
12. WINNER’S NAME: For the winner’s name, send a self-addressed stamped envelope to: Amigo Energy Sweepstakes Winner, 3800 Buffalo Speedway Suite 500, Houston TX 77098 by December 31, 2011.
